Effective Date: December 5, 2025 Welcome to CoffeeFire (the "Website" or “site”), operated by CoffeeFire, a sole proprietorship based in Sorrento, British Columbia, Canada (we, us, or our). By accessing, browsing, or using the Site, or by placing an order for our fire starters and biomass fuel cubes (the "Products"), you (the "Customer" or "you") agree to be bound by these Terms and Conditions ("Terms"). These Terms form a legally binding contract between you and us. If you do not agree with these Terms, you must not use the Site or purchase any Products. We reserve the right to update these Terms at any time and continued use of the Site or Products after changes constitutes acceptance of the revised Terms. We will notify you of material changes by email or a prominent notice on the Site. These Terms comply with the Business Practices and Consumer Protection Act (BPCPA), as amended by Bill 4 (effective March 31, 2025), the Sale of Goods Act (SGA), the Canada Consumer Product Safety Act (CCPSA), and other applicable laws in British Columbia and Canada. As an online seller, this is a "distance contract" under BPCPA Part 4. Product Information and Distance Sales Disclosures Our Products are non-toxic, sustainable fire starters and biomass fuel cubes made from renewable, locally sourced materials (e.g., coffee grounds and soy wax). They are designed for efficient, odorless combustion in outdoor fireplaces, wood stoves, campfires, or indoor fireplaces with proper ventilation. Each package includes usage instructions, safety warnings, and storage guidelines. Pre-Purchase Disclosures (BPCPA s. 46): Business Identity: CoffeeFire, Sorrento, BC V0E 2W0; gilmored@coffeefire.ca; 250-517-7170. Products: Fire starters/biomass fuel cubes. Total Price: $0.50-$0.62 CAD per unit plus applicable taxes and shipping. Example: 24-pack = $XX (incl. GST) + $XX shipping = $XX total. All prices in CAD. No hidden fees. Payment Methods: Credit/debit card via [e.g., Stripe/PayPal]; secure processing. Delivery: Orders shipped via Canada Post within 3–5 business days from receipt of payment. Estimated arrival: 5–10 business days within Canada. Track your order via provided tracking number. Delays beyond 30 days allow cancellation (BPCPA s. 49). Availability: Products are made-to-order; limited stock. If unavailable, we'll notify you and offer alternatives or refunds. Products comply with CCPSA standards for safe consumer goods and are free from harmful chemicals. See product labels for full details. 2. Orders and Acceptance Orders are offers to purchase and subject to acceptance by us. We may refuse or cancel orders (e.g., due to pricing errors or stock issues) and will refund any payment promptly. Confirmation emails serve as order acknowledgment, but acceptance occurs upon shipment. You confirm all provided information (e.g., shipping address) is accurate. 3. Safety Instructions and Disclaimer WARNING: Fire products can cause burns, fires, or injury if misused. Our Products must be used strictly per included instructions and local fire codes (e.g., BC Fire Code). General Use: Ignite in a safe, non-flammable container. Burn time: ~10–15 minutes per cube. Indoor Use: Only in well-ventilated areas with smoke detectors and fire extinguishers. Follow NFPA or local regulations. Prohibitions: Keep away from children, pets, and flammable materials. Never leave burning unattended. Do not use in prohibited areas (e.g., balconies without approval). Storage: Store in a cool, dry place away from ignition sources. We provide these instructions to promote safe use, but compliance is your responsibility. Under CCPSA, we ensure Products are safe when used as directed, but we disclaim liability for non-compliance. Report safety issues to us or Health Canada. 4. Warranty and Refunds Statutory Warranties (SGA ss. 17–18): Products come with implied warranties of merchantability (fit for ordinary use) and fitness for purpose (reliable ignition/combustion). Goods must be of acceptable quality, free from defects, and match descriptions. These cannot be excluded. Express Warranty: 30-day satisfaction guarantee on unopened Products. If defective (e.g., fails to ignite due to manufacturing error, not misuse), we'll replace, or refund at our discretion. Refund Policy: Defective/Non-Performing Products: Contact us within 14 days of receipt at gilmored@coffeefire.ca with photos/details. We'll work personally to resolve (e.g., replacement or full refund). Used items non-returnable for safety. Wrong/ Damaged Shipment: Full refund/replacement upon return (we cover return shipping). Change of Mind: 7-day cooling-off period for unopened Products (BPCPA s. 47 for distance contracts). Return in original packaging; you pay return shipping. Refunds processed within 15 days of receipt. Process: Email us for a return authorization (RA#). Ship to: CoffeeFire, 3562 White Lake Rd, Sorrento, BC V0E 2W0. Shipping costs non-refundable. No refunds on custom orders or international shipping duties. Exclusions: Misuse, normal wear, or unauthorized modifications void warranties. See Returns section below for details. 5. Limitation of Liability To the maximum extent permitted by law, our liability for any claims arising from the Products or Site is limited to the purchase price paid. We are not liable for indirect, incidental, consequential, or punitive damages (e.g., lost profits, property damage beyond the Product value), even if advised of the possibility. This includes, but is not limited to, injuries, damages, or losses from: Misuse, improper handling, or failure to follow instructions/safety guidelines. Unsafe environments or negligent behavior. Product interactions with other materials. Under BPCPA and SGA, we cannot exclude liability for: gross negligence, willful misconduct, or breach of statutory warranties. CCPSA imposes strict liability for unsafe products causing harm. Fire risks are inherent; use at your own risk. 6. Shipping and Delivery Shipments via Canada Post (or equivalent). Risk of loss transfers to you upon delivery. We insure shipments; file claims with us for lost/damaged packages. 7. Returns Unopened Products: 7–30 days per policy above. Ship with RA#; refunds exclude shipping unless defective. Used fire products non-returnable due to safety/hazards. 8. Cancellation Rights (Distance Contracts) Under BPCPA Part 4: Pre-Shipment: Cancel anytime before shipment for full refund. Post-Shipment: 5 days from receipt if disclosures missing (s. 47); 30 days for future performance issues. Notify us in writing; return unopened items at our expense if compliant. No penalty fees. We'll confirm cancellation and process refunds within 15 days. 9. Privacy and Data Protection We respect your privacy under BC's Personal Information Protection Act (PIPA). Personal data (e.g., name, address, email) is collected only for order fulfillment, shipping, and marketing (with consent). We do not sell data. See our Privacy Policy for details, including access/withdrawal rights. Wix (our host) processes payments securely; review their policy. 10. Intellectual Property All Site content (text, images, logos) is our property or licensed. You may not reproduce without permission. Products may have trademarks; do not reverse-engineer. 11. Governing Law and Dispute Resolution These Terms are governed by the laws of British Columbia and the federal laws of Canada, without regard to conflict principles. Any disputes shall be resolved exclusively in the courts of British Columbia. Under BPCPA (as amended), you may not waive rights to class actions or use mandatory arbitration for consumer claims. You may also seek remedies via Consumer Protection BC, Civil Resolution Tribunal (CRT), or small claims court. We'll attempt informal resolution first.12. General Provisions. Entire Agreement: These Terms, plus any order confirmation, constitute the full agreement.
Severability: Invalid provisions do not affect others.
Force Majeure: We are not liable for delays due to events beyond control (e.g., natural disasters).
Prohibited Conduct: No fraudulent orders; we may report violations.
Assignment: You may not assign; we may.
